Terms of service

Welcome to Mighty Cursor! These terms of service (“Terms”) govern your use of the voice-responsive AI-powered application, Mighty Cursor (“MC” or “the App”), provided by Mighty Cursor Pte Ltd (“Company,” “we,” or “us”). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. Eligibility

• Age requirement: You must be at least 13 years old to use the App if you reside in Singapore or the United States, or the minimum digital consent age in your jurisdiction. If you are under 18, you represent that you have the consent of a parent or guardian to use the App.
• Platform requirements: The App is available for macOS devices running on Apple Silicon processors.

2. Your account

• Account creation: To use the App, you must create an account by providing accurate and complete information, including your name, email address, and password.
• Account security: You are responsible for safeguarding your account credentials. Notify us immediately of any unauthorized access to or use of your account.
• Prohibited activities: You may not share your account credentials or use another user’s account without permission.

3. Your data and privacy rights

We are committed to protecting your privacy. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.

We process your data in Singapore. For U.K. and EU users, we ensure adequate safeguards for cross-border data transfers, such as Standard Contractual Clauses (SCCs).

4. User content

• Your content: Any queries or inputs you provide to the App, as well as the outputs generated by the App, belong solely to you. Mighty Cursor does not claim ownership of your content.
• License for services: By using the App, you grant us a limited, non-exclusive, royalty-free license to process your inputs and outputs solely for the purposes of delivering, maintaining, and improving the App.
• Data usage settings: Mighty Cursor does not use your data to train third-party AI models, and user data is stored in compliance with applicable privacy laws.

5. Prohibited conduct

You agree not to:

• Reverse engineer, decompile, or tamper with the App or its APIs.
• Circumvent security measures, overload the system, or disrupt the services.
• Share a single account among multiple users or organizations. Each user must have their own account and subscription.
• Use automated scripts, bots, or other means to artificially generate completions or exploit subscription limits.
• Use the App for unlawful, fraudulent, or harmful activities, including content that infringes intellectual property or privacy rights.
• Use outputs from the App to develop or train other AI or machine learning systems.

Mighty Cursor reserves the right to monitor account activity, including usage patterns and IP addresses, to identify and address potential abuse. Violations of these Terms may result in immediate termination of your account and potential legal action.

6. Pricing and payment terms

• Subscription model: The App operates on a monthly subscription basis, as outlined during sign-up.
• Free trial: New users may access the App for free for up to 1 million tokens. Beyond this limit, a paid subscription is required.
• Fair use policy: While subscriptions allow for a defined number of completions, excessive usage that impacts service quality for other users may result in temporary restrictions or account review.
• Payment processor: Payments are processed through Stripe under their terms and privacy policy.
• No refunds: All payments are final, and no refunds are offered.

7. Intellectual property

• Ownership: All intellectual property rights in the App, including its software, design, and features, are owned by Mighty Cursor Pte Ltd.
• User feedback: We welcome feedback and suggestions about the App. By submitting feedback, you grant us a perpetual, royalty-free license to use it without obligation to you.

8. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Mighty Cursor Pte Ltd and its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your breach of these Terms;
• Your use of the App, including your content and outputs; and
• Violations of any applicable law or third-party rights.

9. Dispute resolution

• Informal resolution: Before filing a formal claim, you agree to contact us at [Support Email] to attempt to resolve disputes informally.
• Jurisdiction: Any disputes arising from these Terms shall be governed by the laws of Singapore and resolved in its courts.

10. Beta services

The App may include features labeled as “beta.” These beta features are provided for testing and evaluation purposes and may not function as reliably as other parts of the App. Your use of beta features indicates your agreement to provide feedback and acknowledgment of their limitations.

11. Third-party services

The App integrates with third-party services, including but not limited to language models (LLMs) provided by companies such as OpenAI. While we strive to ensure these integrations function as intended, Mighty Cursor Pte Ltd is not responsible for the accuracy, reliability, or suitability of outputs generated by these third-party services. Any issues arising from such outputs should be directed to the respective third-party service provider.

12. Limitation of liability

• No liability for damages: To the maximum extent permitted by law, Mighty Cursor Pte Ltd is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.
• Accuracy disclaimer: The App’s AI responses are not guaranteed to be accurate or suitable for all use cases. Use your own judgment when relying on outputs from the App.
• “As-is” basis: The App is provided “as-is” and “as available,” without warranties of any kind.

13. Termination of service

• By users: You may terminate your use of the App at any time by uninstalling it and canceling your subscription through the Paddle dashboard.
• By the company: We may suspend or terminate your account for violations of these Terms, non-payment, or misuse of the App.
• Inactive accounts: Accounts with unpaid subscriptions will become inactive, and access to the App will be restricted.

14. Modifications

We may update these Terms from time to time to reflect changes in our services or legal requirements. Users will be notified of significant updates via email. Continued use of the App constitutes acceptance of the revised Terms.

15. Miscellaneous

• Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Entire agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Mighty Cursor Pte Ltd regarding the App.
